Marshall C. Smiland is an attorney practicing in the areas of business litigation and transactions. Mr. Smiland has represented clients in contract and tort cases, including a case that involved the court-ordered wind up of a Texas business entity, has tried business cases to verdict in both state and federal court, and recently argued before the United States Court of Appeals for the Fifth Circuit (and won). Mr. Smiland has also assisted in numerous eight-figure mergers and acquisitions (both asset and equity transactions), and has drafted organizational and governing documents for Texas business entities, employment agreements, non-compete and non-solicit agreements, settlement and release agreements, and other business contracts.
A proud “Double Longhorn,” Mr. Smiland received both his B.A. and his J.D. from the University of Texas. Mr. Smiland double majored in history and economics and received his B.A. from the University of Texas in Austin in 2016. While working towards his B.A., Mr. Smiland was recognized on the College of Liberal Arts’ Dean’s Honor List and with University Honors, was admitted to the Phi Alpha Theta History Honors Society, and was selected to participate in the Normandy Scholars Program. Mr. Smiland then followed up his undergraduate achievements by receiving his J.D. from the University of Texas School of Law in 2020. While attending law school, Mr. Smiland gained valuable legal experience by participating in the University of Texas School of Law’s Capital Punishment Clinic and Criminal Defense Clinic.
Mr. Smiland is licensed by the State Bar of Texas to practice before the county, district and appellate courts of the State of Texas. Mr. Smiland is also admitted to practice before the United States District Court for the Northern District of Texas and the United States Court of Appeals for the Fifth Circuit. He is a member of the Dallas Bar Association, the Bar Association of the Fifth Federal Circuit, and the Texas Bar College.
