Class Actions

Class Action lawsuits are unique and difficult cases. They involve complicated issues of class representation, commonality of claims, and notice to the class members. Eric Calhoun has been involved in the handling of numerous class actions. Along with co-counsel, he has obtained several large class action settlements in the area of predatory lending, aggregating in excess of one hundred million dollars.

Mr. Calhoun's class action practice includes violations of the Real Estate Settlement Procedures Act ("RESPA"), the Truth in Lending Act ("TILA"), as well as other state and federal laws governing mortgage lending. Mr. Calhoun is also actively pursuing class actions involving overcharges for title insurance premiums paid by borrowers when they refinanced the mortgages on their homes.

Mr. Calhoun also handles various other class actions, including cases filed under the Electronic Funds Transfer Act ("EFTA") and other federal laws.
